These Terms & Conditions (“Terms”) govern your access to and use of this website and any services provided by Growth Digital HUB. By using this website or engaging our services, you agree to these Terms.

Business Identity

Growth Digital HUB operates as a sole proprietorship in the State of Florida and provides services under the trade name “Growth Digital HUB.”

We provide digital marketing services, including but not limited to:

  • SEO, Local SEO, and Google Business Profile optimization
  • PPC and paid media management (Google Ads and other platforms)
  • Conversion Rate Optimization (CRO) and landing page optimization
  • Analytics, tracking, and reporting setup
  • Marketing strategy consulting

Specific deliverables, timelines, and responsibilities are defined in a written proposal, scope of work, or services agreement (“SOW”). If there is a conflict between these Terms and a signed agreement, the signed agreement controls.

No Guarantee of Results

Marketing performance depends on multiple factors beyond our control, including algorithm changes, competition, budgets, platform policies, and client responsiveness. We do not guarantee rankings, lead volume, revenue outcomes, or return on ad spend (ROAS).

Client Responsibilities

To support delivery and performance, the Client agrees to:

  • Provide accurate business information and timely access to required platforms
  • Review and approve materials in a timely manner
  • Maintain active access to ad accounts, analytics, CRM, hosting, and related tools
  • Respond to and follow up with leads promptly

The Company is not responsible for results impacted by missed calls, delayed responses, sales process issues, capacity constraints, or operational execution.

Intellectual Property

Unless otherwise agreed in writing:

  • Upon full payment, the Client owns final deliverables created specifically for the Client.
  • Growth Digital HUB retains ownership of templates, frameworks, and internal methodologies.
  • Clients may not resell, duplicate, or redistribute proprietary frameworks without written consent.

Payment Terms

Payment terms are defined in the applicable invoice, proposal, or SOW. Unless otherwise stated:

  • Monthly services are billed in advance.
  • Past due invoices may result in suspension of services.
  • Fees are non-refundable once work has been performed.

Third-Party Platforms

Our services may involve third-party platforms such as Google, Meta, Microsoft Ads, CRM systems, analytics tools, and hosting providers. We are not responsible for platform outages, policy changes, account suspensions, or cost fluctuations caused by third parties.

The Client is responsible for compliance with third-party terms and policies.

Website Use

You agree not to:

  • Use the Website for unlawful purposes
  • Attempt unauthorized access to systems or data
  • Copy, scrape, or redistribute Website content without permission
  • Interfere with the Website’s operation or security

Limitation of Liability

To the fullest extent permitted by law, Growth Digital HUB is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, business interruption, or advertising spend losses.

The total liability of Growth Digital HUB for any claim arising out of services shall not exceed the amount paid by the Client for services during the three (3) months immediately preceding the event giving rise to the claim.

Indemnification

The Client agrees to indemnify and hold harmless Growth Digital HUB from claims, damages, liabilities, costs, and expenses arising from:

  • Client-provided content, materials, or instructions
  • Misleading, false, or non-compliant advertising claims supplied by the Client
  • Violations of laws, regulations, or third-party rights related to the Client’s business practices

Confidentiality

Both parties agree to keep non-public business information confidential, including marketing data, access credentials, pricing, and strategy. Confidential information does not include information that is publicly available or independently obtained without breach.

Termination

Termination terms are defined in the applicable SOW or service agreement. Unless otherwise stated, either party may terminate services with written notice. All outstanding balances remain due upon termination.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules.

Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Website constitutes acceptance of the updated Terms.
